The Labour Court overturned a €10,000 discrimination award to Jurij Larigin on William Conway’s appeal, finding that the complaint of discriminatory dismissal was not well founded. The determination was signed on 12 March 2013.
Larigin said he was dismissed because of his nationality. Conway argued that Larigin had been engaged while his son was away training and that the work ended when his son returned. The Court found Larigin was an employee, but that his employment ended because the work was no longer available.
The Court also found that the later dispute over unpaid wages and Conway’s call to Gardaí did not show nationality bias in the earlier dismissal. It upheld the appeal and set aside the Equality Officer’s €10,000 award.
