The Labour Court rejected a worker’s appeal over disability discrimination and victimisation claims against the Department of Social Protection, upholding the Equality Officer’s decision. The Court signed its determination on 8 February 2013.
The worker said an assessment in April 2010 led to him missing out on promotion because of his disability. The Court found he had not established facts or produced credible evidence from which discrimination could be inferred, and rejected that part of the appeal.
He also said the department suspended him in retaliation for his equality complaint. The Court found the reason for his suspension was unrelated to the complaint and rejected that part of the appeal.
