The Labour Court upheld a €15,000 pregnancy discrimination award to Andrzelika Rozploch after dismissing Niall Gillick T/A Twist Foods’ appeal. The determination was signed on 11 November 2013. The award related to the termination of Rozploch’s employment during her pregnancy.
Rozploch said she stopped working on medical advice and later received a P45 stating her employment had ended on 1 November 2009. Gillick said he had not intended to dismiss her and believed she could return to work after her pregnancy. The Court found that issuing the P45 had the effect of involuntarily ending her employment. After learning she believed she had been dismissed, the employer made no effort to clarify her employment status. The Court concluded the termination was discriminatory and affirmed the Equality Tribunal’s €15,000 compensation award.
