The Labour Court disallowed Joe Ryan’s appeal over disability and marital-status discrimination complaints against Mountwood Fitzgerald Park Community Development Company Limited, affirming the Equality Tribunal’s decision. The determination was signed on 8 March 2012, and the appeal produced no compensation award.

Ryan, a youth worker on a community employment scheme, said his disability made it difficult to write a report without help. He alleged he was shouted at and that his placement was not renewed because he did not produce it. The employer denied shouting at him or refusing help and said his placement ended when its scheduled term expired.

The Court found no evidence of detriment or verbal abuse over the report. It found Ryan’s employment ended when the scheme term expired and no link had been established between the non-renewal and his disability. On the marital-status complaint, the Court found no basis to regard three wage payments by cheque as indirect discrimination against a separated parent with children. It rejected both grounds of appeal.
