The Labour Court rejected Vadym Kalinin’s appeal against TMF Management (Ireland) Ltd, finding no race discrimination, victimisation or entitlement to equal pay. It dated its determination 9 July 2012.

Kalinin alleged discrimination in his working conditions, training, promotion and study assistance, as well as victimisation and unequal pay. The company denied discrimination and said it had arranged for a trainer to travel from Amsterdam to Dublin. The Court found Kalinin had not established facts from which race discrimination could be inferred. It also found that the comparator’s higher pay reflected his qualifications and relevant experience, and that enforcing the non-compete clause arose from company policy rather than Kalinin’s discrimination complaint.
