Labour Court strikes out four workers’ race discrimination appeal after they miss hearing

The Labour Court struck out the race discrimination appeal by Dainius Vaitkevicus, Ramune Jurgutiene, Arvydas Gecas and Ricardas Jurgutis after none appeared in person to give evidence. The determination was signed on 26 June 2012, and the Court affirmed the Equality Tribunal’s decision. The workers had appealed the Tribunal’s decision in their claims against former employer JSD (Ni) Limited. Although they were represented by counsel, the Court said the appeal was a new hearing and their claims could not succeed without their evidence. The merits were not decided by the Labour Court.
