The Labour Court affirmed the dismissal of Mohamed Hassan’s race discrimination complaint against HSE Addiction Services, disallowing his appeal. The determination was dated 2 December 2011. The complaint related solely to his dismissal in 2005, and Hassan lodged it with the Equality Tribunal on 16 August 2008.
The Court found the complaint was brought outside the time limit and was not well founded; the merits were not decided. It said the time limit had expired before the complaint was lodged and the Equality Tribunal had no jurisdiction to hear it. The Labour Court concluded that the Tribunal’s decision was correct and affirmed it.
During the appeal, Hassan also sought to raise other employment issues. The Court said those matters had not been before the Equality Tribunal and could not be raised on appeal.
