The Labour Court upheld the Equality Officer’s decision that Maris Garais was not victimised by his former employer, Darragh Kane t/a DK Window Systems. The determination was dated 21 November 2011. Garais said his dismissal was retaliation for bringing proceedings under the Employment Equality Acts. The Court found his employment ended through the employer’s actions and inactions, but found no evidence that it was a reaction to those proceedings. It noted the nine-week gap, the lack of intervening signs of hostility and the employer’s business reasons. Claims about training, conditions of employment, discriminatory dismissal and harassment had been withdrawn.
