The Labour Court disallowed John Mavroudis’s appeal against Carlow Institute of Technology on his age discrimination and dismissal claims. Its determination was signed on 10 August 2011.

Mavroudis said four unsuccessful promotion applications and the handling of his PhD application led him to retire early. The Institute argued that the promotion complaints were out of time and denied discrimination or dismissal.

The Court found it had no statutory authority to hear the promotion complaints because the vacancies predated September 2004 and the claims were referred in December 2007; those complaints were outside the time limit and the merits were not decided. It considered the PhD-related dismissal claim on its merits, finding that Mavroudis’s retirement plans were tied to pension age and course changes, not the PhD application. It found no merit in his claim of discriminatory dismissal and upheld the Equality Officer’s decision.
