The Labour Court rejected Ann Hurley’s appeal against the Equality Tribunal’s decision on her victimisation complaint against County Cork VEC, dated 26 July 2011. It found no victimisation in the January and May 2008 incidents it considered; the earlier alleged incidents were outside the time limit and statute-barred, so their merits were not decided.

Hurley said her unsuccessful applications for teaching posts were linked to an earlier equality complaint. The VEC said appointments were made on merit and interviewers did not know about her earlier proceedings. For the January post, the Court heard that reference requests had been sent to her referees. For May, a college principal said there was no resource-teacher vacancy and that website forms had been posted during testing. The Court affirmed the Equality Tribunal’s decision.
