The Labour Court remitted Calor Teoranta’s appeal over Sharon Brierton’s age discrimination pay complaint to the Equality Tribunal for investigation. The determination was dated 27 June 2011. The Equality Officer had found against Calor Teoranta on its preliminary defence that the pay difference reflected relative seniority. The Court said it could not advance the appeal without evidence about differences between Brierton’s work and her comparator’s work, which the Equality Officer had not considered. Neither the complaint nor the appeal was decided on its merits.
