The Labour Court allowed Irish Life and Permanent Trading As Permanent TSB’s appeal and set aside the Equality Officer’s €45,000 award to Mary Higgins for direct gender discrimination. The determination was dated 8 June 2011.

The Equality Officer had found that Higgins was directly discriminated against on gender grounds, but had not established direct or indirect discrimination on family status grounds. At the Labour Court hearing, the respondent offered no evidence on direct discrimination and conceded its appeal on that issue. The parties said they had settled all remaining issues, leaving nothing to refer back to the Equality Officer.
