The Labour Court rejected Gundars Timma, Romans Nazarovs and Robert Grasis’s appeal against Flynn Concrete Products Ltd, upholding findings of no race discrimination. It also upheld the finding that Timma was not victimised. The determination was signed on 7 June 2011. The workers said their employment conditions had not been supplied in a language they understood. The Court considered employment documents and other correspondence provided in English and Latvian. Timma also alleged that his dismissal followed his discrimination complaint; the Court found no evidence linking the dismissal to that complaint. A separate Labour Court determination under health and safety legislation awarded Timma €10,000; that award was outside this appeal.
