Labour Court upholds decision against Ruta Dagyte’s gender discrimination appeal

The Labour Court upheld the Equality Officer’s decision that Crest Stores Limited did not discriminate against Ruta Dagyte on gender grounds. The determination was signed on 27 April 2011, and Dagyte’s appeal failed. She had argued that a P45 issued when she began maternity leave amounted to discriminatory dismissal. The Court found that Crest Stores took steps to correct the error, preserved her statutory and contractual entitlements, and had not dismissed or discriminated against her. Dagyte withdrew her race-ground dismissal complaint at the appeal hearing.
