Labour Court rejects Arturas Businkas’s discrimination appeal

The Labour Court disallowed Arturas Businkas’s appeal against Eupat Limited (In Voluntary Liquidation) and affirmed the Equality Tribunal’s decision. The determination was signed on 13 April 2010. Businkas had complained about his employment terms and dismissal, alleging race discrimination based on his nationality, and also raised pay and overtime under an industry agreement. The Equality Tribunal found it had no jurisdiction to enforce the agreement. It found that Businkas had not established different treatment in his working conditions or shown that his dismissal was connected to his nationality. The Labour Court adopted the earlier decision in full.
