The Labour Court overturned a €30,000 discrimination award to Catherine Morgan after Bank Of Ireland Group appealed. The determination was signed on 20 April 2009.
Morgan alleged indirect discrimination after her request for part-time or job-sharing work was not facilitated until 2005. The bank said such arrangements depended on business needs and suitable opportunities. The Court found the allocation arrangements did not disadvantage women compared with men and that the bank's response to Morgan's renewed request was not unreasonable. It set aside the Equality Tribunal decision and found Morgan had not been discriminated against on either ground.
