The Labour Court overturned the €5,000 harassment and €15,000 discriminatory dismissal awards to Aidotas Gedrimas, finding that he had not established that either was because of his race.
Mulleadys Limited appealed the Equality Officer's findings. The determination was signed on 28 October 2009. Gedrimas did not cross-appeal.
The Court found insufficient evidence to infer race discrimination and said the dismissal was for disciplinary reasons. It noted procedural defects in the dismissal process, but said those did not establish discriminatory dismissal. The Court also considered the nickname used for Gedrimas inappropriate, but insufficient on its own to establish discrimination; Gedrimas said he had no difficulty with it.
