The Labour Court affirmed a €30,000 award to Zena Boyle, dismissing Ely Property Group Ltd’s appeal against findings of gender discrimination and harassment. The determination was signed on 15 October 2009.
Boyle alleged discrimination in her working conditions and dismissal, as well as harassment. The company denied the claims, saying she was dismissed during probation after performance complaints and an unauthorised mobile phone bank mandate.
The Court found Boyle was better qualified than the man who replaced her and that the company had not shown gender played no part in its treatment of her, including her dismissal. It also found gender-related graffiti harassed her and the company took no action to prevent it.
The €30,000 award included €10,000 for loss of earnings. The Court also affirmed orders requiring a harassment code, staff training on it and Boyle’s P45.
