Labour Court disallows worker’s appeal over discrimination time limit

By Niamh Kearney

The Labour Court disallowed a worker’s appeal and affirmed the Equality Tribunal decision that his discrimination complaint against the Minister For Enterprise, Trade And Employment was out of time. The determination was signed on 15 June 2009; the merits were not decided. The worker said the department had failed to provide FAS with resources for support he needed in connection with his learning disability. The worker’s support services were provided in or about April 2004, and he complained to the Equality Tribunal on 22 May 2006. The Labour Court said the claim was referred about two years after the events and that alleged misrepresentation could not have caused the delay because it occurred after the complaint was referred.
