The Labour Court disallowed John Cotter’s appeal against a finding that he had not suffered age discrimination in a competition for assistant principal at Abbeyfeale Vocational School. The Court’s determination was signed on 15 May 2009.
Cotter argued that the selection process disadvantaged him because of his age, citing older references, limited recent in-service training and his participation in school activities. County Limerick Vec said the competition followed Department rules and that Cotter received the maximum marks for service. The Court found the facts did not raise a presumption of discrimination and affirmed the Equality Tribunal’s decision.
