The Labour Court dismissed Micheal Mc Goldrick’s appeal against a finding that the Health Services Executive had not discriminated against him on age or gender grounds in relation to pay. The Court dated its determination 15 May 2007.
Mc Goldrick, a sessional pharmacist, said he received eight hours’ pay for a full day while a female comparator received five hours for a morning session and four for an afternoon session. The HSE said those were the agreed rates for the sessions, with eight hours applying to a full day.
The Court found that pharmacists’ payment practices had varied, including some erroneous payments, but said the age and gender figures did not establish a prima facie case of discrimination. It upheld the Equality Officer’s decision and dismissed the appeal.
