Labour Court reduces hotel worker’s disability discrimination award to €10,000

Labour Court ·

The Labour Court reduced a hotel worker’s compensation award from €15,000 to €10,000 after the hotel appealed a disability discrimination finding. It dated its determination 18 December 2007.

The Equality Officer had found that the hotel discriminated against the worker in her employment conditions and dismissed her because of her disability. The worker said she had told the hotel about her disability during recruitment and needed an accessible office. The hotel disputed knowing about her needs and argued that adjustments would impose a disproportionate burden.

The Labour Court found that the worker’s disability had more than a trivial influence on the end of her employment. It also found that the hotel had not made sufficient enquiries or considered whether adjustments could let her continue in the job, and that special facilities would have enabled her to do it. The Court varied the Equality Officer’s decision and awarded €10,000. The gender finding was not appealed, and the determination gives no outcome on victimisation.
