The Labour Court dismissed Dublin City University’s appeal and upheld a finding that it discriminated against Ms Jane Horgan by failing to appoint her as an Associate Professor. In a determination dated 4 September 2007, the Court upheld €10,000 compensation and directed the University to appoint her with retrospective salary and benefits from 14 November 2002.
Ms Horgan said the University applied different rules to her choice of referee and that she was the only candidate not questioned by experts in her field. The University argued that candidates were assessed against criteria rather than against each other.
The Court found that Ms Horgan had greater academic qualifications and more publications than the male comparators. It also upheld requirements for gender composition on interview panels and contemporaneous interview notes.
