The Labour Court allowed Omar Khatimy’s appeal and awarded him €5,000 in compensation after finding that he had been harassed on racial grounds at work by a colleague. The determination was dated 22 May 2006. The Court varied the Equality Officer’s decision.
Dublin Airport Authority, Shannon Airport, formerly Aer Rianta CPT., was liable for the harassment because it had not proved it took all reasonably practicable steps to prevent it. The Court said producing a workplace policy alone was insufficient. Khatimy said racist remarks were directed at him; the Authority relied on its Respect and Dignity at Work policy and said staff received it or were briefed during induction.
The Court found no evidence connecting the non-renewal of Khatimy’s fixed-term contract to his harassment complaint.
