The Labour Court dismissed a Dublin Bus driver’s disability discrimination appeal and affirmed the Equality Officer’s decision. The determination was dated 18 September 2006. The driver said Dublin Bus treated him less favourably by paying him under its welfare scheme after an injury at work, while employees unable to work after assaults on duty received better terms. The difference between the payments was about €21,000. The Court accepted that colleagues incapacitated after workplace assaults received more favourable treatment and that the driver had a disability. It found the difference arose because they had been assaulted at work, not because of disability, and held that Dublin Bus had not discriminated against him.
