The Labour Court has affirmed the rejection of a worker’s disability discrimination and victimisation complaints against HSE - North Western Area, dismissing an appeal brought on her behalf by the Irish Nurses Organisation. The determination was dated 3 August 2006. The complaints concerned two nursing promotion competitions, efforts to arrange suitable work after the worker’s disability, refusal of approval for a management course and alleged victimisation over her initial exclusion from a competition and the ending of pension-rate payments. The Court found the interview questions reasonable for the roles and accepted the employer’s explanations of the competition scoring. It found no evidence that disability influenced the decisions, and concluded that the qualification query and pension-rate decision did not amount to victimisation.
