Labour Court dismisses Ms G’s appeal over Berkeley Court Hotel disability complaint

The Labour Court dismissed Ms G’s appeal over her disability discrimination complaint against Berkeley Court Hotel, Dublin, in a determination dated 21 February 2005. It found the complaint was brought outside the six-month time limit and that no extension had been sought; the merits were not decided. The Court said the hotel’s decision not to return Ms G to her former House Assistant role was confirmed in a letter dated 2 May 2001. Later negotiations, her return to work and lower earnings were consequences of that decision, rather than separate acts.
