The Labour Court rejected Dunnes Stores’ appeal as out of time in a determination dated 24 January 2003; the merits of the underlying discrimination complaint were not decided. Dunnes had appealed an Equality Officer decision concerning Madeline Boylan. Dunnes argued that the 42-day appeal period should start the day after the Equality Officer’s decision. The Court held that the period began on the decision date, 14 March 2002, and that Dunnes’ appeal, filed on 25 April, was late. The law did not allow the Court to extend the deadline.
