In 2002, the Labour Court disallowed a complainant’s appeal over an alleged disability discrimination claim concerning a Civil Service Clerical Officer post with typing duties. It affirmed the Equality Officer’s decision that The Civil Service Commissioners had not discriminated. The complainant passed the written and typing tests but did not meet the required standard at interview.
The Court said the competition was confined to candidates with disabilities, so the complainant could not establish less favourable treatment against a candidate without a disability. It also found the statistics cited in support of the claim insufficient because they covered only eight candidates in one competition. The determination was dated 7 October 2002.
