The Labour Court upheld the decision that Huseyin Turkay’s two working-time complaints against former employer Pamukkale Trading Co Limited Anatolia Cafe and Restaurant were filed out of time. The decision is dated 13 August 2024. Turkay lodged the complaints with the Workplace Relations Commission in February 2023, about 11 months after leaving his employment. He argued that his vulnerability, limited English and other circumstances explained the delay; the employer disputed that there were grounds to extend the deadline. The court found no adequate excuse for the delay and ruled that the complaints were statute barred under the time limit. The merits were not decided.
