The Labour Court upheld the decision that Huseyin Turkay’s working-time complaint against former employer Pamukkale Trading Co Limited Anatolia Cafe and Restaurant was filed out of time. The decision is dated 13 August 2024. Turkay lodged the complaint with the Workplace Relations Commission in February 2023, about 11 months after leaving his employment. He argued that his vulnerability, limited English and other circumstances explained the delay; the employer disputed that there were grounds to extend the deadline. The court found no adequate excuse for the delay and ruled that the complaint was statute barred. The merits were not decided.
