The Labour Court upheld the decision against David Walsh’s claim that his standby time as a retained firefighter for Kerry County Council counted as working time under the Organisation of Working Time Act 1997. The determination was dated 8 November 2022.

The Court said this appeal relied on the same facts and reasoning as a linked case. It found Walsh’s standby time was not working time under the Act or the Directive, and that no breach occurred during the relevant period. His appeal failed and the Adjudication Officer’s decision was upheld.
