The Labour Court upheld the Adjudication Officer’s decision after David Walsh’s appeal over retained-firefighter standby time failed. The Court determined that the standby time was not working time under the Organisation of Working Time Act 1997 and that no breach occurred. The appeal concerned complaint CA-00029440-003 against Kerry County Council. The Court said this case relied on the same facts as linked case WTC/20/19, where retained-firefighter standby had been found not to be working time. The determination is dated 8 November 2022.
