The Labour Court disallowed Cristian Balasa’s appeal and affirmed the finding that his complaint against Hydraulic Hose Services Ltd T/A Pirtek was not well founded. In a determination dated 18 September 2020, it found he was not entitled to annual leave or public holiday benefits for the periods considered. Balasa said he had not received annual leave and public holiday entitlements for 10 years. The Court refused to extend the time limit, finding that the claim was within time only for 20 June to 19 December 2017; earlier annual leave claims were statute-barred. For the period from 1 April to 31 August 2017, it found he was neither working nor on certified sick leave and had no annual leave entitlement. It also found he had been out of work for more than 26 weeks before the August 2017 public holiday and was not entitled to a benefit for it.
