The Labour Court set aside a €2,000 Sunday-work award and the public-holiday awards against Urbanity Ltd T/A Urbanity Coffee, while increasing annual-leave compensation to €450 for Zuzana Mlcochova. Its determination was dated 30 January 2019.
The employer appealed three decisions concerning Ms Mlcochova, a part-time server at its café. The Court found her hourly rate exceeded the national minimum wage and her contract included compensation for Sunday work. It set aside the €2,000 award.
The Court confirmed she was entitled to €118.17 for accrued 2017 annual leave and directed the employer to pay €450 compensation, varying the original €300 compensation award. On the public-holiday complaint, the Court reviewed undisputed payslips and timesheets and found she had been fully compensated for her 30 October 2017 shift. It set aside the original €29.25 payment and €500 compensation awards.
