Labour Court allows Ta Hotels Ltd Lynams Hotel appeal to proceed

The Labour Court ruled that Ta Hotels Ltd Lynams Hotel could proceed with its late appeal after finding that exceptional circumstances prevented it from filing within the 42-day limit. The determination was dated 30 January 2018. The company said WRC correspondence went to an old address despite its having updated its registered office details. Vireshwarsingh Khoosye argued that the company had time to appeal after learning of the decision. The Labour Court found the correspondence had gone to the wrong address and ruled that the appeal could proceed. The preliminary decision addressed only the time limit; the underlying complaints and any awards were not decided.
