The Labour Court allowed Euro Car Parks (Ireland) Limited’s appeal and set aside the finding that Patrick O’Hanlon’s working-time complaint was well-founded. The Court signed its decision on 18 May 2018. The Adjudication Officer had found the complaint well-founded because no transfer had occurred when the company’s contract to run Paul Quay Car Park ended on 14 November 2016. In a related appeal, the Labour Court determined that a transfer had taken place by operation of law, so the company’s appeal succeeded. O’Hanlon did not attend the hearing and his solicitors told the Court he would not contest the appeal.
