The Labour Court awarded a worker €1,200 after finding that a public transport company failed to give him the required notice of his working hours. The determination was dated 20 April 2017.
The spare driver said that being told his precise start time at 1pm the previous day did not give him 24 hours’ notice. The company relied on a collective agreement and advance notice of a range of possible starting times, but could not prove the agreement existed. The Court found that a range from 4.30am to 10am did not meet the notice requirement and that the worker lacked proper notice on more than 20 occasions. It described the breach as systemic and ordered the company to take steps to comply with the law, while noting that it was already taking steps to provide the required notice.
