The Labour Court increased Agnieszka Dominiak’s compensation to €750 after allowing her appeal over unpaid Sunday work at MCT Catering Limited Chocolat. In a determination dated 4 December 2017, the Court varied the Adjudication Officer’s decision, which had awarded her €325.50.

Dominiak, a supervisor, said she received no Sunday premium from March 2015 until her employment ended in November 2016. The Court considered the period from 14 June to 9 November 2016 under the six-month time limit and found no compensation had been paid for Sunday work during that period. MCT Catering Limited Chocolat did not attend the hearing.

The Court found that the employer contravened section 14 of the Organisation of Working Time Act, which requires compensation for Sunday work when it is not already reflected in pay. It set compensation at €750 as just and equitable in the circumstances.
