The Labour Court varied a decision in favour of bar waitress Layala Smalli, directing Meades Bar Limited T/A Victoria Café to pay her €2,000 compensation. The determination was dated 27 November 2017. Smalli worked at the café from October 2015 to July 2016. The Court found that claims relating to three earlier public holidays were outside the period it could consider. For four holidays within that period, it preferred Smalli’s evidence that she had not received extra pay. It also found that her €10 hourly rate did not include annual leave pay and that €1,152 remained due when her employment ended. The Court awarded €320 for the public holiday breach and €1,152 for the annual leave breach. The €2,000 compensation includes both amounts. It set aside the Adjudication Officer’s decision and replaced it with its determination.
