The Labour Court upheld two working-time complaints by Nigmatas Orlovicius against JR Boning (Ireland) Limited, leaving a €3,700 compensation award in place. The determination was dated 16 June 2016.
Orlovicius said he often worked long shifts without adequate breaks. The company disputed his account and said breaks were arranged around the production line. The Court found that the company had not produced records to show it provided the required breaks or gave notice of additional working hours. It also rejected the company’s application to recover its €300 appeal fee, finding it responsible for missing the first hearing after changing its registered address without notifying the Commission or arranging mail forwarding.
