The Labour Court varied the earlier decision and partly upheld an appeal by Sahin Akkoyun And Suat Salik T/A Capital Kebab House. In a determination dated 19 April 2016, it retained findings that Ismet Aydogan had not received adequate notice of changed hours, annual-leave entitlements or public-holiday entitlements. The Court found no reasonable grounds for extending the time limit, restricting the periods it could consider. It also noted that the employers produced no records to support their accounts of paid leave or public-holiday entitlements. It directed payment of €500 for the notice breach, €1,050 for annual-leave economic loss plus €750 compensation, and €210 for public-holiday economic loss plus €500 compensation. Payment was due within six weeks.
