The Labour Court found that Rehabcare T/A Rehab Care breached working-time rules on daily rest, breaks and Sunday work in Sylvia Ozurumba Mc Jyn's appeal. It awarded her €500 for the daily-rest breach and €1,000 each for the breaks and Sunday-work breaches. The determination was signed on 18 April 2016. The Court also ordered an additional day's pay for the section 21 breach involving the public holiday on 17 March 2015. It found no breach of sections 15 or 23. For the break claim, the Court preferred Mc Jyn's evidence about arrangements for forwarding calls so she could take breaks; Rehabcare had no records of breaks taken. For Sunday work, the Court found the contract did not clearly identify how the salary addressed compensation for working Sundays.
