The Labour Court disallowed Viktorija Karavajeva’s appeal over short-notice changes to her work roster, affirming the Rights Commissioner’s recommendation. The determination was signed on 11 April 2016. Karavajeva said she was often given only an hour’s notice of changes and could not refuse requests to work. Martin Quigley (Nenagh) Ltd said staff were occasionally asked to cover absences and could refuse. The Court preferred the employer’s evidence, finding that Karavajeva could refuse requests and that changes responded to unforeseeable circumstances. It found no breach of section 17 of the Organisation of Working Time Act, 1997.
