The Labour Court disallowed Analog Digital Security’s appeal and increased Robert Murphy’s compensation from €100 to €500 in a determination dated 24 September 2015. Murphy said he was not given the required 11 hours’ rest between shifts, sometimes driving from Limerick to work in Dublin after leaving home at 5am and returning after 10pm before an early start the next day. The company denied breaching the law and said he worked no more than his contracted 39 hours a week. The company accepted it had not kept records in the statutory form. The Court therefore placed on it the burden of proving there was no breach, preferred Murphy’s account and found in his favour. It awarded €500, varying the Rights Commissioner’s decision.
