The Labour Court disallowed Andrzej Gera’s appeal and raised Tomasz Krawczyk’s compensation from €350 to €10,000 in a determination dated 24 September 2015. Krawczyk, a baker at Gera’s Family Bakery Samo Zdrowie, said he regularly worked more than 48 hours a week; Gera said he worked no more than 30.
The Court found Gera’s evidence unreliable and accepted Krawczyk’s account and diary, which recorded weeks of 70 to 98 hours. Gera had not kept the required working-time records, leaving him to prove compliance. The Court found serious and persistent breaches of the 48-hour weekly limit and awarded €10,000, varying the Rights Commissioner’s decision.
