The Labour Court found Marek Marciniuk’s Sunday premium complaint well founded, but made no further compensation award because Wicklow Recreational Services Ltd Trading As Shoreline Leisure Centre had paid the 25% premium. The determination was signed on 15 April 2015. Marciniuk, a part-time leisure attendant, also complained that he was denied public holiday entitlements and penalised after making complaints. The Court found the public holiday complaint not well founded because he had been paid for both holidays, although the May payment was one week late. It found the penalisation complaint not well founded because he presented no supporting evidence. The Court did not allow his appeal.
