The Labour Court upheld the Rights Commissioner’s decision that Celina Jakubiak’s complaints against Laurel Enterprises Limited T/A Centra were not well founded. The determination was signed on 19 March 2015. Jakubiak said the company failed to provide adequate breaks on Sundays and pay compensation for Sunday work. The Court found that she had not worked on any Sunday during the period covered by her complaints. It accepted the company’s evidence that Sunday staff received a premium and that Jakubiak was not rostered to work on Sundays. The Court also found material parts of Jakubiak’s evidence unreliable, including her recollection of Sunday opening hours and staffing.
