The Labour Court set aside a Rights Commissioner’s decision and awarded Sylwia Matijuk €500 after finding working-time breaches by Clontarf Castle Limited T/A Clontarf Castle. The determination was signed on 16 November 2015, following Matijuk’s appeal.
The Court found the employer had not kept adequate records to show Matijuk received her breaks, and concluded she missed breaks on an unspecified number of occasions. It also found daily rest was not provided immediately before a 24-hour rest period on two occasions. A five-cent-per-hour Sunday premium was not reasonable, and the employer had not clearly established that her finishing times matched those notified to her.
The Court further found the employer failed to pay her in advance for two days of annual leave. It found she had received her entitlements for both public holidays. The €500 was compensation for the contraventions found, without separate amounts allocated to each.
