Labour Court upholds working-time award after Kok Kellys appeal

The Labour Court affirmed the Rights Commissioner’s recommendation in Joseph O' Neill’s working-time case after Kok Kellys Ltd appealed the amount. The determination was signed on 9 November 2015. Both sides agreed that only the amount was at issue. Kok Kellys argued that O' Neill’s dismissal for alleged gross misconduct should be considered; O' Neill disputed the grounds and said they were before the Employment Appeals Tribunal. The Court said it could not trespass into the other tribunal’s business and noted that Kok Kellys had advanced no other substantive argument for varying the award.
